TERMS AND CONDITIONS OF SALE

By purchasing or upon ordering from Helmetor Limited Company, you agree to be bound by the terms and conditions set out in the terms and conditions of sale below.

 

Helmetor Limited Company, a Company by Limited Guarantee under the Laws of Northern Ireland with its Head Office located at 12 Sessiagh Road, Inishmore Island, Inishmore Road, BT94 5PQ;

 

AND: You the customer of Helmetor helmet holder

 

WHEREAS, Customer/user of Helmetor helmet holder, wishes to use the Helmetor helmet holder under the conditions of this Limited Warranty.

 

NOW and THEREFORE, in consideration of payment of said product and of the mutual promises set forth, the terms and conditions set out below are as follows:

 

    LIMITED WARRANTY

The Company warrants that (a) its Helmetor helmet holder  when used under normal usage and for the purpose sold for, namely to be used as an aid to the storage  of a helmet, in accordance with instructions of use. Helmetor Ltd will not be responsible for damage caused by the improper use of the Helmetor helmet holder. Always follow the manufacturers' recommendations for the use of helmet accessories.

 

Helmetor Ltd will not be liable for loss or damage caused wholly or mainly by your breach of these conditions.

 

Helmetor Ltd will not be liable for any loss or damage which could not have been reasonably foreseeable by Helmetor Ltd and loss or damage outside their control.

 

This limited warranty is effective to the supply by Helmetor Ltd of new goods and is not transferable to you the customer selling or giving to a third party the Helmetor helmet holder.

 

   CUSTOMER REMEDIES

The Company and its suppliers’ entire liability and Customer’s exclusive remedy shall be, at the Company’s option, either (a) return of the price paid for the Helmetor helmet holder or (b) repair or replacement of the Helmetor helmet holder. This Limited Warranty is void if the Helmetor helmet holder has become defective as a result of accidental damage to said holder or damage resultant from abuse, or misapplication of use. 

 

   NO OTHER WARRANTIES

This limited warranty gives customers specific legal rights pursuant to the sale and purchasing of goods within the jurisdictional legal territory of the United Kingdom. Any disputes concerning warranty will be subject to the Court jurisdiction of England and Wales in the Courts of Northern Ireland.

 

   NO LIABILITY FOR DAMAGES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HELMETOR LTD  OR ITS SUPPLIERS OR SALES AGENTS/AGENCY, BE LIABLE FOR ANY DAMAGES, CAUSATIVE BY IMPROPER USE, USE WHILST DEFECTIVE, WHATSOEVER (INCLUDING WITHOUT LIMITATION, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES FOR PERSONAL INJURY, LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY/IMPROPER USE OF THIS PRODUCT, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

 

   TERMS AND CONDITIONS OF SALE

Price and payment.

The price of goods shall be at the price Helmetor Ltd inform the Purchaser by means of internet pricing of unit sale or by written contractual agreement between a person acting with the authority of Helmetor Ltd and you the customer. Prices will include VAT at the current United Kingdom rates unless otherwise stated.

 

You the customer will be required to pay in full, the said amount on a given due date for goods ordered, failure to pay the due sum will cause ownership not to pass to the customer and Helmetor Ltd will retain ownership. Helmetor Ltd reserve the right to recover loss incurred with the recovery of unpaid unit sales.

 

Until title of ownership passes to you, you will ensure secure storage of Helmetor goods. Unsafe or careless storage leading to damage of Helmetor helmet holder will result in Helmetor Ltd recovering said costs from you.

 

You confirm upon presenting with payment of goods that you have authority to proceed with same payment method and have authorisation to use payment method.

  ORDERS

​

By ordering goods online, you confirm that you are 18 years old with capacity to contract.

 

Orders placed on line, must be accompanied by you, the customers’ name, address, post code, landline telephone or mobile number, a valid e-mail address and valid payment details. Helmetor Ltd will ensure that the highest confidentiality is afforded to your personal details in compliance with Data Protection legislation and that a secure mode of payment will be employed by Helmetor Ltd to take receipt of your payment.

 

Any acknowledgement by automated e-commerce on behalf of Helmetor Ltd to you when you place an order online, shall not amount to our acceptance of your offer to purchase.

 

Helmetor Ltd reserves the right, at the discretion of the Board, to reject any order without giving a reason.

  DELIVERY RULES AND RESTRICTIONS, POSTAGE

​

POST BREXIT:

​

We ship all our orders  direct from Northern Ireland Northern Ireland remains a part of the European single market and the customs union. As such, there are no additional charges, fees or duties on orders delivered from us to Europe, GB or worldwide. Purchasing direct from us has not changed due to Brexit.

​

Please note: Here at HELMETOR we correctly mark all packages with the appropriate XI EORI number.

If you are EU based and you are challenged for an additional fee, please flag this at your end with the courier. Let them know the XI EORI number

and remind them that the parcel has been delivered from Northern Ireland which remains part of the European single market and customs union.

  • We have tried to keep our postage costs to a minium.

  • For UK deliveries we use Royal Mail 2nd class (untracked).

  • For International deliveries we use Royal Mail International Standard (untracked).

  • Some other options are available at checkout

  • We aim to get your items to you as quickly as possible.​​

  • Our target for dispatch after you order is next working day.

  • Orders are shipped on business days only. Business days are Monday to Friday, excluding public holidays in the United Kingdom

  • Please note that Royal Mail do not guarantee this timeframe but  'aim' to deliver within that period.  They advise up to 20 working  days for E.U. countries and up to 25 working days for the rest of the world.

  • US: ROYAL MAIL'S PARTNER IS USPS

  RETURNS

 

All goods are delivered with an unconditional 28-day money back guarantee in addition to your rights under the Consumer Protection (Distance Selling) Regulations 2000.

We hope that you will love your Helmetor®, however if this is not the case, we will refund any item that you are not completely satisfied with when you return it unused and in it's original packaging  within 28 days of purchase.

In order to return goods under our money back guarantee, you must email us at info@helmetor.com or write to us within 14 working days of delivery of the goods, and you must arrange for and pay the cost of returning the goods to us.

GUARANTEE

This guarantee allows you to remove the Helmetor from the packaging (i.e. cutting the two zip-ties), trying it in your helmet vents and in the event of it not working in a 30mm-65mm vent, you may send it back to us (in a condition that would allow it to be repackaged and sold).  We will then refund you in full (including the postage from the first transaction).

The postage cost of returning the Helmetor(s) is not covered by Helmetor® Ltd.

Before returning it please contact us at info@helmetor.com... we may ask for photographic evidence.

Helmetor Ltd in certain conditions and in accordance with the Sale of Goods-Consumer Rights Legislation effective at the time of sale, such legislation pursuant to the jurisdiction of the United Kingdom, may refund or replace goods. Helmetor Ltd will endeavour to replace  or refund orders  within 28 days of notification by you the customer in accordance of said legislation.

 FAULTY OR DAMAGED GOODS

​

If goods are found to be faulty or damaged upon delivery, or not of satisfactory quality, please contact Helmetor® within fourteen working days of receipt of the goods, stating how the goods are faulty.

​

We will, at our discretion, deliver replacement goods or refund the price paid. Your statutory rights are not affected.

​

  COMPLAINTS AND DISPUTES

​

Helmetor Ltd Company prides itself as providing first class products and after sales service. We are confident that you the customer will be satisfied with our products. However in the event that you feel the need to complain, please do so by emailing info@helmetor.com whereupon we will do all we can to resolve your complaint.

  YOUR PERSONAL INFORMATION

​

Helmetor Ltd will need to retain information in order to provide you the customer with goods on order. We will only use your information for the purposes you provided it to our Company and we will not share it with any third party outside the control of Helmetor Ltd. Helmetor therefore undertakes to comply with the data Protection Act 1998 and will therefore ensure that your information is;

  • used fairly and lawfully

  • used for limited, specifically stated purposes

  • used in a way that is adequate, relevant and not excessive

  • accurate

  • kept for no longer than is absolutely necessary

  • handled according to people’s data protection rights

  • kept safe and secure

  • not transferred outside the European Economic Area or any other party within another Country without adequate protection and your permission. 

  • In accordance with the GDPR, site visitors have the right to access their data or "be forgotten" (to be permanently deleted from your databases).
